Pay Phony Product Reviewers First, Then Pay FTC Later

Pay Phony Product Reviewers First, Then Pay FTC Later

Advertisers now can know with confidence there is a costly toll to pay to the Federal Trade Commission (FTC) for using online product “reviews” by affiliates that pretend to be independent but aren’t. In a March 2011 settlement in In re Legacy Learning Systems Inc., the FTC – for the first time – imposed financial penalties on an alleged violator of provisions of its Revised Endorsement Guides that were added in 2009 to address testimonial practices in online marketing. It also ordered the institution of a tough affiliate monitoring and disciplinary program that’s a precedent for the type of compliance measures the FTC expects online marketers to take to ensure product reviews are for real and don’t mislead consumers.

Legacy Learning Systems sold a home guitar instruction program through “Review Ad” affiliates it recruited and paid to promote its courses through endorsements in articles, blog posts and other online editorial material. The FTC claimed the reviews violated the Endorsement Guides because they falsely posed as the opinions of ordinary consumers or “independent” reviewers and did not disclose at all, or clearly enough, that affiliates made money on sales.

As an example, one review said: “Read my Independent Review and Discover the Truth of Learn & Master Guitar Now.” Another said it was “The Independent Reviews Site…Learn and Master Guitar emerged from our test as the King of ‘learn guitar at home’ courses.” The FTC also alleged that Legacy Learning Systems failed to enforce affiliate contracts that required them to comply with FTC disclosure guidelines.

To settle, Legacy Learning Systems agreed to pay $250,000 and implement a rigorous affiliate compliance monitoring and zero-tolerance disciplinary system requiring it to:

  • Monitor and submit monthly reports to the FTC about its top 50 money-making affiliates and ensure they are disclosing they’re paid for sales and are not misrepresenting themselves as independent users or ordinary consumers
  • Monitor and submit monthly reports on a random sampling of another 50 affiliates to ensure they also disclose the financial connection and don’t misrepresent who they are
  • Immediately terminate and stop payment to any non-complying affiliate

The mechanism of a regular FTC reporting requirement should be plenty of stick to make sure the company meets its settlement obligations to monitor affiliates and swiftly can those who don’t tow the line. If it doesn’t, it could find itself in contempt and facing even greater sanctions.

Other online sellers who sponsor product reviews won’t be under such a microscope, but should still heed Legacy Learning Systems as a signal the FTC is conducting its own “affiliate monitoring” program to enforce the Endorsement Guides against phony reviews – and will make marketers who pay for them without consumers’ knowledge pay the FTC as well.

My GoogleOS ChromeBook Laptop Review

I got my Google ChromeBook earlier this month.  Google did this pretty smart marketing tactic where they offered to “Give Away” the laptops.
In order to qualify to “demo” the laptop you had to punch in all this information about why you should get it… what your expertise is and if you are a business owner you had to fill out a bunch of other stuff to “qualify”.

I never got a free demo unit but I did “get a chance” to purchase the laptops for each of my employees one 2 weeks before they would go on sale to the general public.  Everyone I know got this email who applied to get a demo unit.  +1 google marketing.

I bought one.  $499.  I am the guy who has to always have the latest gadget….  My employees love it cause they usually get it after I am bored with them in a week.

But on to the ChromeBook and my impressions.  Please keep in mind I currently am always torn between taking my ultra heavy macbook pro 17” and my 11” macbook air.

First of all before even turning it on I was in love.  This thing has everything I have been wanting in a laptop for a long time.

Screen :

Screen perfect size it feels like a 14”.  Very usable on aircraft and all around use.  Nothing spectacular.  Would not be surprised if it was not a LED.  Felt like a standard LCD.

Always connected Internet:

When you are not using a wifi network you have the built in 3g through Verizon.  Free for 100MB of data then priced up from there.  I currently pay for tethering on my iPhone and a Verizon mifi.  So this will save me about $650 a year with the 5GB plan per month (even tho I don’t Think I would use anything close to that.

I can’t tell you how nice it is not to have to lug around a 3g card and making sure its charged and crap.  Then it always seems like when you need it the most it has issues.

SD Card Slot:

This may come as a surprise to most but my 11” Macbook Air and my 17” Macbook Pro do not have a SD Card slot.  I have to have an adapter for both.

Having a built in SD card slot is nice to have.

No Cd drive:

I love this.  I don’t know why ANY laptop comes with a cdrom anymore.  It adds a lot of weight and takes up a ton of space that could be used for more battery life.

Solid state drive – Enough Said

Keyboard:

Very nice layout.  The keys feel good almost like a ruber finish.  A lot nicer to type on than my Macbook’s.

Ok so now lets get into the actual “real life” use of the computer.  I have only used the Chromebook since I got it so I could give it a real review.

The operating system

The operating system on the front end is basically like the chrome web browser.   You can download the chrome operating system for free if you ever want to check it out.   If you are not a linux users I recommend downloading Parallels free trial and choose install ChromeOs from the menu.

Applications:

This is the one area that actually really surprised me.  There are TONS of applications already for the ChromeOS and tons being developed every day.   I was happy to be able to grab dropbox and other stuff that I enjoy on my MacOSX computers.

However I was unable to find a 1password extension/app or a few others.  That is pretty close to a deal breaker for me as I can’t log in anywhere without it.   But I expect a 1password app very soon.

My day to day use:

I find I am far more productive on the chromebook than my macbook pro’s.  I think this is mostly due to the fact that I can’t do anything other than access web applications and the terminal.  But that is what I do when I actually “work”… so its pretty sweet.

Overall impression:

This is a slick laptop and its got productivity written all over it.  I got one for my assistant instead of a 2k+ macbookpro and she loves it.  Its very lightweight and snappy.  Depending on what you are looking for in a laptop it could be a perfect fit.

The ShoeMoney TV Segment

Most of you probably remember our weekly “ShoeMoney Questions Video’s“.    We filmed 20 episodes.  It as a lot of fun and people seemed to really enjoy them.

One day when we were about into episode 15 we had a Nationwide based agency approach us about taking the segment nationwide.

The pitch to us was basically that local TV stations are getting crushed between cable, on demand services, and sites like HULU, and are also very scared about the upcoming Google TV network.

Local stations are HUNGRY for unique content that people will tune in for that they can’t get anywhere else.

SO…  They thought that this would be a interesting thing sell.

We produced 5 episodes last week all answering left over questions from the ShoeMoney Questions Blog stuff.  They are really basic “How to make money online questions”.  The ones we filmed so far were:

  • How to make money with twitter.
  • How businesses can use facebook to increase revenue.
  • How to manage your reputation online.
  • How to make money with Google Adsense (of course).
  • How businesses can use Groupon and tips to be successful.

Its VERY VERY VERY newbie oriented stuff.

There are a couple test markets who have picked up the show and it will air starting next week.  Depending on viewership (and return viewership) they will then try to sell the segment nation wide.

This is exciting stuff for me and will inflate my ego by 10x….  but I have a feeling its going to bomb and that will be that =P.

Blog comments.

The blog comments have really died off lately but our traffic has been increasing month by month and this month is double what last month was:

So why would the blog comments be down if traffic is up?

Well ….. a little while back I imported this list of ips that were known spam and proxy havens… only issue is some of them contained ips like 214 or 10.  That was it…  So everyone with that number anywhere in there ip was sent right to the trash… sweet move.  Sorry about that!

What Marketers Can Learn From The Green Lantern

Yesterday my wife and I went to go see The Green Lantern.  Green Lantern was always my favorite super hero. I never read the comic books but I watched the Justice League of America religiously… So I didn’t really know the backstory. All I knew is he could make his ring form anything he wanted in front of him.

Why would you want to be any other superhero limited in powers…. Green Lantern can make a gun or maybe even a superman or money or a hot chick whatever limitless. Green Lantern rules.

What I didn’t know about Green Lantern is that his ring gets its juice from other peoples will. In this movie he goes up against a monster that gets his power from other peoples fear and kills them.

I don’t want to ruin the movie so I will stop there.

I could not help but think about how everyone I know that is successful has an iron will and while they like to always challenge themselves with new things, they are fearless.

Willpower is an amazingly powerful thing.  Some people could determine my willpower as cockyness.  I just know I will always figure out a way to win.

I am not afraid to stick my pecker out.

Maybe because I have hit rock bottom before in my life that I know that even in lives worst moments I have and can find a way to survive.

Wills can be broken though.

This industry is filled with broken wills.

I think there are several reasons for this:

  • People follow exactly what others are doing – Exhibit A:  John Chow’s I make money by telling people how to make money online. Have you seen any make money online blogs from people who actually don’t make money?  Yea… When was the last time they were updated?  5 posts in a year?  No posts in years? Broken will.
  • People try to get started but give up very easily – Someone just bought the latest “Overnight Riches” info product and when it didn’t plant a money tree in their back yard.  Now don’t get me wrong I have met a LOT of people at events who purchased a $97 ebook (I have spent probably 50k on info products myself) but the one who really dedicate themselves to it are few and far between.  Broken wills.
  • People find something hot… then it dies – In 2004 a passion project working in my spare time out of my house turned into a multimillion dollar company.  I literally tripped over a rock and fell into a hole filled with money.  All thanks to a phone call from a Google AdSense rep telling me I should place AdSense on my site.   But I never believed it was going to last and quickly leveraged it to the next thing.  Now 6 years later I have several companies.  But a lot of people will blow all there cash on hookers, blow, cars, etc…  Then they don’t know what to do.   Will is broken.

There is probably a ton more reasons peoples will to make money on the internet gets broken.

The sad thing is what become of these people.  Most of them become HATEFUL at people who are successful.  Show me the biggest haters on the internet and I will show you a guy who either tried and failed or was successful and eventually failed.

Lots of times broken wills = hate for those who do have the will power.

Just like with Green Lantern who had the will to win many other Green Lanterns had failed because they lacked the will and succumed to fear.

If I listened to what people said…

I get so many tweets, facebook messages, and posts asking if I saw what people said about my blog. I will be honest. If you want to annoy me send me messages telling me people are doing it.

I have said this 8000 times but here goes again. This blog is my thoughts and just my notes on what I am learning and experiences I have had. I probably refer back to it more than anyone.

If others find this useful then great. If people think its dumb then ok.

I wrote this blog when nobody read it and someday when nobody reads it again I will still write. I enjoy it… regardless of if it makes money or not.

People are always going to have opinions. Just search for ShoeMoney in forums. You will see everything from:

“ShoeMoney never gives out any good information anymore”

Or…

“OMG ShoeMoney just talked about how awesome linked wheels are and now we are all fu*ked”.

I love writing this blog and I do enjoy the fact that tens of thousands of people read it every day. I hope they read it because it enlightens and entertains them.

But either way I will still be here writing a average of 4 posts per week (almost 8 years now) about whatever is on my mind.
