Dillsmack Gets Threatened With Lawsuit

When we were about to leave St. Louis late weds night Dillsmack got a call from some folks who evidently did not like his opinion of phoenix imaging. It also is the first time that Dills has been threatened with a suit. I remember the first time someone threatened to sue me (about 6 years ago) … I was pretty scared.

    They don’t have a leg to stand on because it’s the truth, the onus is on them to prove that his account didn’t happen that way. Plus, in that post, besides the title being Phoenix Imaging Sucks, has hardly any disparaging comments about the company, just an account of what happened (which would lead the reader to understand why it is that Phoenix Imaging Sucks).

    Slander: a malicious, false, and defamatory statement or report.

    Doesn’t seem to me like his post meets this definition. More power to dillsmack for reporting the truth. The claim won’t stand up in court if it even goes that far.

    Yes its true it wont go that far in court at all even if things do get critical.

    Phoenix doesn’t have a legit reason for sueing Dill. The whole thing is silly. A company putting force on a client that shush up just because they don’t want others to know about their shoddy customer service.

    Lots of webhosting companies sue forums for the same thing, and most lose.

    Agreed, it’s an honest account, and all a lawsuit would do is make them look worse than they already do. It would be fun to get Dillsmack’s story to #1 for Phoenix Imaging (it’s already at #10).

    Sounds like they lost your part to me - hoping that you’d forget about it if they stopped contacting you long enough.

    What friggin idiot…some people shouldn’t be in business. You should counter sue for your part back in the People’s Court! :-) dunt..dunt…dunt

    So did Dil ever get his part? How was the quality of it? Looks like they just raised hell on their own company by blowing things up.

    If they wouldn’t have sued then maybe only a few people would read Dil’s page from 2005. Now that people are blogging about it a whole bunch more people no about it.

    They will probably not sue. Seems like a scare tactic and as long as the author made it clear to be his personal opinion, his defense is unsinkable.

    Jeezum, people will sue for just about anything these days.

    I read the story on Dillsmacks site, but I was a little disappointed that he didn’t finish it completely. He never mentioned if he got the thing back in a week or what.

    It really sounds like that company sucks though and he documented everything pretty good.

    getting sued sucks… when i was 16 me and my parents were sued because i was in a car wreck that wasn’t my fault! a suit for 100,000 bucks never was resolved though, they finally dropped it because of witness testimony against them lol

    The thing I wrote is 2 years old. I did get the dash back a couple weeks after I wrote that, but never updated it. The phone call on Weds brought this all back up.
