MySpace Goes After Affiliate Network CPA Empire

by Jeremy Schoemaker on January 23, 2007 · 22 comments

Scott Richter, one of the most successful spammers high volume email deployers ever, was named in a lawsuit filed in Los Angeles court last Friday.

In the suit MySpace claims:

Richter and his associates “arranged for millions of spam ‘bulletins”‘ to be sent from MySpace users’ accounts without their knowledge by gaining access to them illegally, according to the lawsuit.

His last company lost a a 50 million dollar judgment to Microsoft for spamming of which they only paid 7 million before filing for bankruptcy protection.

It seems CPA Empire owner Scott Richter Just cant get a break… He also ran a clothing line called “Spam King” until it was stalled by a trademark lawsuit by Hormel Foods, which owns the trademark to edible SPAM.

I talked to Scott here in at the Affiliate Summit yesterday for a brief moment. He seemed a little flustered. Maybe this suit had something to do with it. I wish I would have known then about it I would have asked him about it.

So this is pretty interesting MySpace is going after people for spamming MySpace bulletins and setting a example with the self proclaimed “spam king”
This is actually very ironic cause I was talking to a very big affiliate company about Richter and his appearance on the Daily Show:

Scott told me about how the show it was all scripted and all in good fun. Personally I think it was a INCREDIBLY BAD IDEA for him but I dont mean that really from a marketing aspect more from a… wow for the rest of my life everyone is going to make a example out of me as a spammer.

I’m starting to wonder if I should shy away from CPA empire.. I don’t want to see them go bankrupt from a huge lawsuit, and I don’t get paid anymore. Do you use them for anything these days, SM?

interesting angle Leroy. If are found guilty its possible that CPA Empire might shut down like his last company did (they paid 7 million to Microsoft of the 50 million dollar judgement) then went into bankrupt

It was scripted to maximize his foolishness. The last part with the yahoo mail was really fake tough.

It’s not so much that they were spamming MySpace bulletins that caused the lawsuit as much as the fact that they used phishing to steal accounts to do it. If it’s true, then MySpace should sue to protect its users. It’s like credit card companies going after people who steal credit card information. MySpace has to protect the users’ sensitive personal information. Otherwise, they lose user trust and people will stop using MySpace.

Also, if MySpace didn’t go after the phishers it could cause a potentially large lawsuit to be brought by users who had their information stolen. That’s a very large potential liability for MySpace and its owner News Corp.

Hope you get a chance to yack about this on your show today Shoe. There are lots of rumours flying about that a list of networks are on the court filing (myself included) but i am yet to see anything official. Jon claims to have some inside info, but he is ona plane back from ASW.

Anyway, hope you are doing a show today and that you can address this subject and shed some facts on the rampant rumours

Is this a suprise to anyone? Most of my non industry friends are sick of Myspace because they’ve had their acounts fished. If I was in Myspace’s position this would have happened months ago.

Weird, I Joined CPA Empire a few weeks ago, the next day, I was getting about 3 – 5 spam emails from them a day. I use Gmail, and it is brilliant for spam filtering, but these are getting through. Fucking Richter

I agree, big mistake on his part to take part, and will forever be branded the S word. Oh well, maybe he can go into comedy instead of High volume email deployment?

Brilliant! Personally I use “Active Defensive Open Source High Volume Email Deployment Hardware” but thats just my preference.
